General Terms & Conditions
OBJECT
The purpose of the present general conditions of sale is to define the legal rights and obligations of the client and of TradeChain Sàrl at 2075 Thielle, CHE-184.997.435 (hereinafter referred to as “TCH”), in the process of selling the products offered on the tradechain.ch website.
THE CUSTOMER
The client declares that he/she is a natural person of legal age, with the legal capacity to accept these general conditions of sale and to place an order on the site. He/she may not make purchases on the site in connection with his/her professional activity or for the purpose of reselling the products ordered. Orders placed must be limited to strictly personal use.
THE PRODUCTS ON THE SITE
The products displayed on the site are offered within the limits of the stocks available in our shops or from our suppliers. Therefore, it may happen that a product is available for a limited period of time, while our stock is being replenished.
Each product is accompanied by a presentation established on tradechain.ch in the most objective way possible in order to satisfy the customer’s need for information.
The images of the products are prepared in such a way as to be as faithful as possible to the real products, but do not guarantee colour accuracy due to the numerous options of screens or internet browsers used by the client.
Errors may occur on the site, and the customer acknowledges and accepts this (e.g., an obvious error on a price).
PRODUCT GUARANTEE
All products sold on the tradechain.ch website are covered by the manufacturer’s guarantee.
Any guarantee is excluded in case of misuse or negligence of the products by the client.
As it is not the manufacturer of the products presented on the site, TCH cannot be held responsible for hidden defects resulting from a defect in the material, in its manufacture and from defective products making them unfit for use.
In the case of a product that appears to be in a defective condition, all claims, requests for exchange or reimbursement must be addressed to TCH within thirty days of the delivery date.
PRODUCT PRICES
The products and prices published in the online shop are considered as offers. However, these offers are always subject to the resolutive condition of an impossibility of delivery or an erroneous price indication.
The prices are displayed in Swiss Francs (Frs or CHF) and include the applicable Swiss VAT. They do not include delivery costs to the customer or other services that are added to the final invoice.
The total price is indicated in the order confirmation delivered to the customer. It includes the price of the product(s), the delivery costs, the handling, packaging and storage costs and the costs of other services selected by the client.
TCH reserves the right to adjust the prices, without prior notice to the client. The prices shown on the site when a product is ordered are the only ones applicable to the buyer, subject to availability of the products.
ORDERS
Before placing an order, the customer will have taken note of the essential characteristics of the products and their prices. The customer is the sole judge of the compatibility of the products ordered and of his/her ability to use them.
The validation of an order does not always guarantee the availability of the products (possible stock error): in case of unavailability, TCH reserves the right to cancel the sale and undertakes to reimburse the customer within thirty working days maximum.
The products ordered on the site follow the procedure set up by TCH according to a succession of steps that the client must respect to validate his order.
In particular, he/she must:
– inform the site of his name, first name, e-mail address and delivery address of the order
– inform the site about the delivery method
– inform the site about the method of payment
– provide the site with the details of the credit card used
– check that their final shopping basket corresponds to what they wish to order
– accept the general conditions of sale
– validate their order
The validation of an order will have the value of a digital signature and acceptance of the operations carried out. Receipt of the order is confirmed to the customer by means of an automatically generated order confirmation by e-mail. The receipt of the automatically generated order confirmation does not contain any confirmation that the product can actually be delivered. It only informs the customer that the online shop has received the order and that the contract has therefore been concluded with TCH, provided that the order can be delivered and that the price indicated is correct.
PAYMENTS
The payment of the products is done at the validation of the order.
Payments are made by bank card in Swiss Francs (CHF) and are subject to a security system according to the PCI DSS standard.
TCH accepts payment by VISA, Mastercard and American Express. TCH does not accept any other method of payment on the site.
When ordering, the customer must indicate the number of his credit card, its date of validity as well as the security code in the area provided for this purpose. The transaction data recorded by the system constitutes proof that the order has been placed.
DELIVERIES
Deliveries are only made within Switzerland.
Orders are delivered to the address communicated by the customer at the time of ordering. In order for the delivery times to be respected, the customer must ensure that he/she provides an exact and complete address.
Deliveries are made by Swiss Post and/or by private carrier for bicycles.
The delivery times indicated on the site are indicative.
It may happen that a product is located in a stock other than the one from which the package will be sent. The final delivery time of the parcel will then include the time taken to return the product to the main stock and the normal delivery time.
TCH cannot be held responsible for a delay in delivery once the parcel(s) have left our stock.
The amount of the delivery costs is displayed on the order validation page.
For reasons of availability, it may happen that an order is delivered in several times to the customer.
DELIVERY RECEIPT
Packages are delivered to the customer from Monday to Friday during the delivery times of the post office and/or the private carrier.
In the case of a delivery made when the customer is not at home, the postman will leave an ‘invitation to collect a parcel’ in the customer’s letterbox. The customer must then collect the parcel from the post office indicated on the card or contact the post office to have the parcel delivered again.
PROBLEMS WITH DELIVERY
In the case of a parcel arriving damaged – i.e., open, torn or damaged – the customer must immediately report it to the postman, and if necessary refuse the parcel. A new parcel will then be sent back to the customer as soon as possible without delivery costs, depending on the availability of this product.
In the case of a parcel that does not contain the right product, the client must contact TCH on the day of delivery or on the first working day following delivery, in order to report the error in the order by e-mail or telephone.
After this period, it is no longer possible for the client to file a complaint about the order and TCH is released from any responsibility to modify the order.
For a parcel that does not contain the right article, it is the responsibility of the customer to return this parcel, with the prior agreement of TCH. The delivery costs are paid by TCH.
If the customer wishes to refuse a package for another reason, he must justify this in writing to TCH on the day of delivery.
RIGHT OF CANCELLATION
The customer has a period of seven clear days from the receipt of the delivery to return the package – at his own expense – if the products are not suitable.
The customer must contact TCH to inform them of the return of the goods.
The returned products must imperatively be new and in their original packaging, not used, not worn, not worn out, not washed, not modified, and not damaged, without any trace of use whatsoever. Any accessories, instructions or other documentation accompanying the product must also be included in the package.
In case of cancellation and return of goods by the customer, TCH will reimburse the customer within fifteen working days after receipt of the goods the value of these products, minus the delivery costs.
DISPUTES
The general sales conditions of TCH are subject to Swiss law.
TCH cannot be held responsible for damages of any kind, whether material or immaterial or physical, resulting from a malfunction or misuse of the products sold on the site. The same applies to product modifications by the manufacturers.
The responsibility of TCH is limited to the amount of the order.
Failing this, the general conditions of sale being governed by Swiss law, only the Swiss courts will have jurisdiction.
PLACE OF JURISDICTION
Any dispute relating to the sale will be subject to Swiss law before the regional court of the littoral and Val-de-Travers, Neuchâtel.
PROTECTION OF PERSONAL DATA
All personal data of customers is collected as established by the TCH Privacy Policy.
TCH reserves the right to communicate to all its clients, by e-mail, telephone or post, commercial offers related to the company’s object of activity.
Upon written request, the client has the right to access, modify, rectify or delete data collected by the site and concerning him.
